Terms of Service

Supplier and scope

Loudwater is provided by Blundens Ltd (company number 14230311), whose registered office is at 483 Green Lanes, London, N13 4BS. Loudwater is the service and trading name; Blundens Ltd is the legal supplier.

These terms govern individual authorised use and the public website. A customer's subscription is governed by its accepted Order Form, Master Services Agreement and incorporated schedules. Those customer agreements prevail if there is any conflict.

Service access

Access to Loudwater is granted to authorized users under school or organization agreements. Users must keep account credentials secure and use the platform only for legitimate education operations.

Acceptable use

• Do not attempt unauthorized access to data, systems, or accounts.
• Do not upload malicious code, harmful content, or unlawful material.
• Do not use Loudwater in ways that disrupt service for other schools.

Data responsibilities

Schools remain responsible for data quality, lawful processing instructions, and user permissions. Blundens Ltd processes Customer Data on the customer's documented instructions under the Data Processing Agreement and provides technical and organisational controls to support secure processing.

Intellectual property

Loudwater software, branding and documentation are owned by Blundens Ltd or its licensors. As between the parties, the customer retains its rights in Customer Data.

Availability and changes

Blundens Ltd may maintain, secure and improve the service. Customer service levels, maintenance commitments and remedies are those in the accepted customer agreement.

Termination

Access may be suspended or terminated for breach of these terms, non-payment under the customer agreement, or legal or security requirements. Organisational access and Customer Data are handled under the customer agreement on termination.

Governing law

These user terms are governed by the laws of England and Wales. The governing law and jurisdiction for a customer subscription are set out in the applicable Master Services Agreement.
